General Terms and Conditions (GTC)

Article 1 - Scope of application
The present General Sales Conditions (GSC) apply, without restriction or reservation, to all sales concluded by the company ODYSSEY on the e-commerce site www.poppycloudy.com, with consumers, non-professional or professional buyers, wishing to acquire the segmented synthetic false eyelash products sold by ODYSSEY (hereinafter referred to as "we" or "the company").

These GCS apply to the exclusion of all other conditions, in particular those applicable to in-store sales or sales via other distribution channels.

The Customer declares that he/she has read these GCS and accepted them by ticking the appropriate box before placing an order. By validating his/her order, the Customer fully and unreservedly accepts all the provisions of these GTC.

Article 2 - Products
The products sold are face girdles named Fit-Mask PoppyCloudy, as described on our website www.poppycloudy.com. The photographs and descriptions of the products are provided for information only. Although every care has been taken to ensure their accuracy, they have no contractual value.

Products are offered while stocks last. In the event of unavailability after the order has been placed, the Customer will be informed as soon as possible and may opt for an equivalent product or request a refund.

Article 3 - Prices
The sale prices of products are indicated in euros (€), inclusive of all taxes (TTC), and are those in force at the time the order is placed. The prices shown include delivery costs for France.

ODYSSEY reserves the right to modify prices at any time, but products will be invoiced on the basis of the prices in force at the time the order is registered, subject to availability.

Article 4 - Ordering

Orders are placed exclusively on the www.poppycloudy.com website. The Customer selects the products of his/her choice and validates his/her order after having accepted the present GTC.

An order confirmation by email will be sent to the Customer after validation of the order and full payment. The sale is then considered final. Customers can consult their order history in their customer account on the site.

Article 5 - Payment

5.1 Terms of payment

You can pay for your purchases by credit card or any other payment method offered on our site.

5.2 Payment security

Transactions are secured by an online payment service provider. Payment information is encrypted and protected.

Article 6 - Delivery

6.1 Delivery time

Products are delivered to the address indicated by the Customer at the time of ordering. Delivery times vary from 4 to 6 working days, depending on the delivery address and product availability.

6.2 Delivery charges

Delivery costs are included in the price of the product for deliveries in France, and are indicated when the order is validated. In the event of an error in entering the delivery address, ODYSSEY cannot be held responsible for delays or failed deliveries. Additional costs for reshipment may be charged to the Customer.

6.3 Delivery problems

If the products ordered are not delivered within 30 days after the indicative delivery date, the Customer may request cancellation of the order by email to contact@poppycloudy.com. The sums paid will then be reimbursed within a maximum of 14 days of receipt of the request.

Article 7 - Right of retraction

In accordance with the law, the Customer has a period of 14 days from receipt of the products to exercise his right of withdrawal without having to justify his decision or pay any penalties, with the exception of the cost of returning the products, which remains at the Customer's expense.

To exercise his right of withdrawal, the Customer must contact ODYSSEY by email with the completed form (see APPENDIX II) and return the products in their original packaging, complete and unused. Full reimbursement of sums paid will be made within 14 days of receipt of returned products.

Article 8 - Crossed-out prices and promotions

The crossed-out prices displayed on the www.poppycloudy.fr website correspond to the previous prices of the products concerned. In accordance with current regulations, these prices have been in force for a minimum period of 30 consecutive days prior to the application of the promotion.

Promotional Codes

8.1 Use of Promotional Codes

The promotional codes we offer are subject to specific conditions indicated at the time of issue. These codes are only valid for the purchase of products on our poppycloudy.com website and must be used before their expiry date.

8.2 **Conditions of use**

Promotional codes cannot be combined with other offers or promotions, unless otherwise specified. They are neither exchangeable nor refundable for cash or other goods/services.

8.3 **Restriction of use**

The company reserves the right to refuse or cancel an order if it suspects fraudulent or incorrect use of a promotional code.

 

9. Customer reviews

Customers may post reviews of products purchased on our poppycloudy.com website. These reviews must reflect honest and constructive opinions based on actual product experience.

9.2 **Moderation of Notices** (in French)

We reserve the right to moderate customer reviews in order to remove any inappropriate, offensive or irrelevant content. Reviews containing defamatory, obscene or insulting language will be rejected.

 9.3 **Use of Notices** (in French)

By posting a review on our site, you authorize us to use and publish that review on our site and in our marketing materials, including but not limited to newsletters, social media and advertising campaigns.

Article 10 - Intellectual property

All elements of the www.poppycloudy.com website are protected by copyright and remain the exclusive property of ODYSSEY. Any reproduction, exploitation or use, in whole or in part, of the elements of the site, whether visual or audio, is strictly forbidden without the prior written consent of the company.

Article 11 - Personal data

Customers' personal data is collected and processed in accordance with the French Data Protection Act of January 6, 1978 and the RGPD. Customers have the right to access, rectify and delete their data by contacting ODYSSEY at the following address: contact@poppycloudy.com.

Article 13 - Disputes and Mediation

These GCS are governed by French law. In the event of a dispute which has not been resolved amicably, the Customer may refer the matter to a consumer mediator. Article 14 - Modification of the GCS

ODYSSEY reserves the right to modify these terms and conditions at any time. The applicable GCS are those in force at the date of the order. Any modification of the GCS will not apply to orders already validated by the Customer.

Appendix I - Legal warranty provisions

 

Legal warranty of conformity

 

Article L217-4 of the French Consumer Code:

 

ODYSSEY is obliged to deliver a service in conformity with the contract and is liable for any defects in conformity existing at the time of delivery.

 

Article L217-5 of the French Consumer Code:

Article L217-12 of the French Consumer Code:

 

Any action arising from a lack of conformity must be brought within two years of delivery of the goods.

 

Article L217-16 of the French Consumer Code:

 

When the buyer asks the seller, during the course of the commercial warranty granted at the time of the purchase or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period.

 

This period runs from the date of the buyer's request for service, or from the date the goods in question are made available for repair, if the goods are made available after the request for service.

 

Hidden defects warranty

 

Article 1641 of the French Civil Code:

 

ODYSSEY is liable for hidden defects in the item sold which render it unsuitable for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he been aware of them.

 

Appendix II - Withdrawal form.

 

The present form must be completed and returned only if the Customer wishes to withdraw from the order placed on the website, except in the case of exclusions or limitations to the exercise of the right of withdrawal in accordance with the applicable General Terms and Conditions of Sale.
